Alabama Lemon Law

Lemon laws were created to protect consumers who unknowingly purchase new or used vehicles with serious defects in them. These laws allow consumers to obtain fair compensation from automobile manufacturers, for vehicles that simply cannot be repaired. In some instances the law even requires manufacturers to provide the consumer with a replacement vehicle.

The specific requirements for filing a lemon law claim vary from state to state. For example, under the Alabama lemon law you can only file a claim if the vehicle's defect affects its use, value, or safety. In addition, the claim must be filed within the first year of ownership or before the owner puts 12,000 miles on the vehicle, whichever occurs first.

Most lemon laws also contain some provisions designed to protect the manufacturer. Hence, before you can sue a manufacturer under the provisions outlined in the Alabama lemon law, you must first give them a reasonable opportunity to repair the defect. The law defines reasonable opportunity as three separate attempts to get the repairs done or the car being in the hands of the dealer or an authorized repair shop for at least 30 days.
